By hiring my services, you agree to the following terms and conditions. Please read them carefully. If you have any questions, I’m here to help.

1. Services

I offer professional photography services in the following categories:

  • Weddings

  • Couples sessions

  • Family sessions

  • Maternity sessions

Each service has specific features detailed in the proposal or contract signed for each event or session.

2. Bookings and Payment Methods

2.1. Securing Your Date

To reserve the date for your wedding or session, an initial payment (deposit) is required. The amount varies by service:

  • Weddings: 25% of the total package price.

  • Sessions: 50% of the total session price.

This deposit confirms the booking and guarantees that the date is reserved exclusively for you.

2.2. Remaining Balance

The remaining balance is paid as agreed:

  • Weddings: On the date stipulated in the contract (usually before the event).

  • Sessions: On the day of the session, before it ends.

  • Deferred Payments: In some cases, payments can be deferred only with credit cards from Ecuadorian banks that offer this option. Not all cards allow it; please check with me to verify.

2.3. Accepted Payment Methods

  • Bank transfer (accounts at Produbanco and Banco Pichincha)

  • Cash deposit

  • Credit card (Visa or Mastercard issued in Ecuador) with an additional 8% surcharge

  • Cash

2.4. Credit Card Payment

If you choose to pay by card, please send me the following information to generate a secure payment link:

  • National ID, Tax ID (RUC), or Passport

  • First and Last Name

  • Email Address

  • Mobile Number

2.5. Payments from Abroad

If you need to make an international transfer or a payment from the United States, please contact me directly so I can send you the available options (including SWIFT code for international bank transfers).

3. Cancellation and Date Change Policy

3.1. Cancellation by the Client

If the client cancels the event or session for any reason, the initial deposit is non-refundable, as the date has been exclusively reserved and commitments have been made.

3.2. Date Change

If you need to change the date:

  • The photographer will do their best to attend on the new date if available.

  • The change must be made within one year from the original contract date.

  • The deposit will remain valid for the new agreed-upon date.

3.3. Cancellation or Change by the Photographer (Force Majeure)

In the event of force majeure, accident, incapacity, or theft that prevents the photographer from fulfilling their commitment:

  • Every effort will be made to find a professional replacement who maintains the same contract conditions.

  • If this is not possible, the client will be notified as soon as possible and 100% of the deposit will be refunded.

  • The photographer is not responsible for additional damages arising from this situation.

4. Delivery of Photographs

4.1. Delivery Timeframe

The maximum delivery time is 40 business days (8 weeks) after the event or session. Although I always strive to deliver earlier, this is the contractually stipulated time.

4.2. Delivery Format

Photographs are delivered as:

  • Private online gallery (for direct download)

  • High-resolution digital format, ready for printing and sharing

4.3. Number of Photographs

The quantity varies according to the contracted service but is clearly specified in the proposal or signed contract. For full weddings, I deliver a minimum of 600 edited photographs.

4.4. Editing

All photographs undergo a professional editing process (developing, color correction, basic retouching). Additional creative editing (advanced retouching, manipulations) may incur an extra cost.

5. Copyright and Use of Images

5.1. Intellectual Property

All photographs taken during the event or session are the intellectual property of Daniel Esteban Maldonado Ramírez, in accordance with Ecuador’s intellectual property laws.

5.2. Usage License for the Client

The client acquires a usage license for personal and non-commercial purposes, which includes:

  • Sharing on social media (crediting when possible)

  • Printing copies for personal use

  • Storing and enjoying the images

5.3. Commercial Use

Any commercial use of the photographs (advertising, product promotion, etc.) requires a written agreement and, in some cases, additional compensation.

5.4. Use by the Photographer

The photographer reserves the right to use the photographs as samples of their work for promotional, educational, or non-profit editorial purposes, including:

  • Web portfolio and social media

  • Contests and specialized publications

  • Studio promotional material

If for any reason you wish for certain images not to be published, we can agree on this in writing before the event.

6. Limitation of Liability

6.1. Scope of Liability

The photographer commits to performing the service with the utmost diligence and professionalism. However, the photographer’s liability is limited to the total amount paid for the contracted service. Under no circumstances shall they be liable for indirect, incidental, or consequential damages.

6.2. Technical Issues

In the unlikely event of technical failure (damaged memory cards, equipment theft, etc.) resulting in total or partial loss of images, the photographer’s sole compensation will be a refund of the amount paid, with no additional liability.

6.3. Weather and External Conditions

For outdoor sessions, if weather conditions prevent the session from taking place, it will be rescheduled by mutual agreement at no additional cost.

7. Processing of Personal Data

In accordance with the Organic Law on Personal Data Protection (LOPDP) of Ecuador, I inform you that:

7.1. Data Controller

Daniel Esteban Maldonado Ramírez is the data controller responsible for your personal data.

7.2. Purpose

The personal data you provide (name, ID, email, phone) is collected solely for:

  • Managing the booking and contract

  • Sending information related to the contracted service

  • Sending the payment link (if applicable)

  • Post-service communications

7.3. Legal Basis

The processing of your data is based on the contractual relationship established when hiring my services.

7.4. Data Transfer

Your data will not be transferred to third parties, except when necessary to process payments (payment gateways, banking entities) or when there is a legal obligation.

7.5. ARCO Rights

You have the right to access, rectify, cancel, and object to the processing of your personal data (ARCO rights). To exercise these rights, you can contact me by email.

8. Applicable Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Ecuador. For any dispute arising from their interpretation or execution, the parties submit to the jurisdiction of the judges and courts of the city of Quito, waiving any other jurisdiction that might correspond to them.

9. Acceptance

By hiring my services, you confirm that you have read, understood, and accepted these Terms and Conditions in their entirety.
